Van Halen Lawsuit Tells Nike "You're No Good"

Shoes from Van Halen's EVH Brand Signature line.Nike's Dunk Low shoe.June 22, 2009: Eddie Van Halen, guitarist for rock band Van Halen, "Ain't Taking About Love" but wants Nike to "Jump" in a lawsuit his company has filed against the athletic shoe and apparel giant for copyright infringement. The suit focuses on a new Nike Dunk Low shoe that Van Halen claimed uses a striped color scheme that he has had trademarked under the name "Frankenstein" for use on his guitars and on a line of recently released shoes. ELVH, feeling that Nike may be "Runnin' With the Devil," filed a copyright infringement complaint in Los Angeles claiming "irreparable harm and damage" and asking for the impoundment and destruction of all the shoes in question and all profits from the sale of the shoes and damages.

Nike responded to the complaint in a statement that read, "Based on the information provided to us, we have not infringed on any rights held by Mr. Van Halen. Nike's Dunk shoe design is not substantially similar to any of the Van Halen designs, and Nike has not referenced the 'Van Halen' name or image as part of any marketing campaign or promotional material associated with the shoe."

Van Halen and partner FEA Merchandising unveiled the EVH Brand Signature Striped Sneakers earlier this year, claiming that "for nearly two decades, Eddie Van Halen fans have been attending Van Halen shows wearing homemade versions of the striped sneakers Eddie wears onstage, modeled after his infamous red- white- and black-striped “Frankenstein” guitar. “So many people would ask me ‘Where can I get a pair of those?’” Van Halen said at the time. “After hearing that for about 15 years, I figured they were something that people obviously wanted, so making them available and official seemed like a natural progression.” According to the Web site, three patterns are available—red with black and white stripes, white with black stripes (like the guitar he used in 1978) and black with yellow stripes (like the guitar seen on the back cover of Van Halen II). All three are available in high-top and low-top versions, with the familiar 5150 tag on the spine. EVH Brand Signature Striped Sneakers are now available online at www.EVHGear.com and at department and specialty stores worldwide. Other EVH signature items include the Wolfgang guitar, 5150 amplifiers and EVH accessories. Back to Home Page
